Why?
A Rechtsstaat (state under the rule of law) means that the law applies to everyone: all residents and also the state itself, including government, police and offices. The state may only act on the basis of laws, and courts check this. Courts apply laws, but they do not make them; parliament does.

Rechtsstaat heißt: Alle Menschen im Land und auch der Staat selbst müssen sich an die Gesetze halten. Regierung, Polizei und Behörden dürfen nur nach Gesetz handeln, und Gerichte kontrollieren das. Gerichte machen keine Gesetze, das macht das Parlament.
